generally the rule is:

- illegal in the u.s. if it's copyrighted UNLESS you own a copy of the cd.

- in other countries, many times uploading of copyrighted files is illegal, but downloading is legal...

it really varies, and lots of the times the laws are somewhat vague. google.com like the last poster said and figure out whats legal and whats not in your country
