The bundled software is optional and not spyware. I won't argue much here because i don't like it either - but how else do you want the program to stay free? get real - it's optional, you DONT have to install it and no it won't ever be like bearshare where it's required.


As far as your point #2 , you could change your options of not dropping download parts in tools > preferences > download tab.
