I'm not sure thats ethical or legal mate,what you've done is distributed a copy of bearshare with minor text changes,you've removed the adware but thats about all!!
Methinks you may have opened up a big can of whoopass

it would be a better idea to make a simple program that writes over those places in a already installed copy of the program. No one can stop you from making a program like that. it does go to show you what people can do about spyware with a simple binary editing program.
