Limewire v. Napster?what's the legal loophole?

Can anyone tell me what the legal differences are between the original Napster and the Limewire/Gnutella system in the U.S.? It all just seems so awfully familar.

The main difference is that Napster had central servers that could be shut down. The Gnutella network does not. The only way Gnutella could be shut down would be if every ISP blocked Gnutella ports.
