Post Good news for Canadian Filesharers--better than expected

Oh Canada!

The CRIA tried suing 29 filesharers, the ISP's resisted turning over the 29 names, and a judge with experience in technological and international commercial relations has ruled against them today.

And---take a look at a really decent forum that deserves all the donations they get for their part in informing this decision:

What really ****** me is that the CRIA sounds contemptuous in insisting that what we are doing is illegal. The Globe and Mail reported

RIAA and CRIAA are the same thing with the same goal: make cash in the end, even if they aren't doing it the right way. They remind me of 50% of Americans (Bush supporters): the world is not enough!

FACTS:
-cd sold are at the same level as the napster era
-the artists still do a ridiculous % of the sale
-a few artists make 50% of the cd sales
-home recording of a cd is now affordable to people (with the evolution of computers and software)
-producing cd with case and cover is available to anybody
-gathering a supporter base can be done for much less with internet and mouth to mouth (shows too!)

YET:
-we pay taxes for every media (cd-r, harddisks, MP3 player) that go to the record companies!!!
-they are sueing people
-they spread FUD to the population (try to tell someone with little P2P knowledge you are not affecting the artist by dling some of his files -that if you like, you might buy his cds-)
-without P2P I would not have bought many CDs of artists that I begin to love after dling their mp3s
-They don't understand the utility of P2P as a marketing tool (it's easy to do stats and trends of popularity by looking at what P2Pers love and download).
-P2P is great to cut bandwidth expenses as a company

olala, CRIAA and RIAA are shameful mongols.

Here's my favourite part of Judge Finckenstein's ruling

Law Society of Canada, 2004 SCC 13, established that setting up the facilities that allow copying does not amount to authorizing infringement. I cannot see a real difference between a library that places a photocopy machine in a room full of copyrighted material and a computer user that places a personal copy on a shared directory linked to a P2P service. In either case the preconditions to copying and infringement are set up but the element of authorization is missing.
Canadians were allowed to download music before, but now looks like people who have put personal copies in their shared folders are also protected by this ruling!
