Default downloaded file sharing

I need to prove to a prosecutor that Limewire's default sharing setting for downloaded videos is to share them. She claims, and the police also say that when Limewire is installed a person has to manually agree to share their files. I agree with this. Where we disagree is what the default setting is for someone who simply downloads a video to their default "download" folder. I am under the impression that this folder is automatically, by default, shared unless changed by the user. I need to know who is right? If I am right is there somewhere that states this? Also is it possible that this has changed from one verison of limewire to the next? My client maintains that he was not knowingly sharing any videos and evidently the default setting had him sharing anything he downloaded. Is he telling the truth? Any help would be greatly appreciated.
