Monitoring files being downloaded

Now that Comcast has been exposed for their attempts to block file sharing, I am wondering who can see exactly what you're downloading? Can the ISP see it? Can a record company look into some history file and see you copied a specific file? What if you download something 'bad' you didnt' want, can somebody track that file? Thanks!
