If you get a certified Letter from the attorneys representing RIAA, check every Label's and artist's website. Many have, and continue to host MP3s that are available for download by the public. Many of them have no disclaimer about use. Therefore, the members of RIAA, who have appointed RIAA to act as their voice in prosecuting computer users as pirates, in some cases gave the very copyrighted works away, without disclaimer, without limitations, and without fare use qualifiers which leaves the consumer the reasonable assumption that the activity of downloading songs, trading songs, and storing songs on their personal computer is both legal and promoted by the Labels, artists, and RIAA. After all, if you hand your car keys to someone, without stipulations, you cannot file thief charges when they drive away. If you or your attorney can find evidence that one song that you’re being prosecuted for is, or was ever on a website owned by the artist or the record label, sue them! Sue the artist and subpoena them to appear in court. If you can show that they gave one song out--it blows a hole in RIAA's case, as it is a reasonable assumption that the activity is permissible and therefore the suit against you is without merit. In fact, copy the following webpage as a favorite, and make it available offline: http://www.norahjones.com/av/default.htm save one of the MP3s. There, you’re now protected. As this page, provided by a current RIAA member, does not have a fair use stipulation or end user notice, is in MP3 format, and is a complete copyrighted work which is sold on a commercially available album.

bookmarked, downloading, and listening. Sounds good, and since I can't find any copyright notices on the mp3's she offers, I'll share--artists like her deserve the advertising we can freely give in return for the favour. I notice she offers a direct purchase of a newer CD, so I might buy that in a bit, but I don't want to go against http://www.boycott-riaa.com/ , so I'll have to check to make sure all the money will go to the artist first. Thanks for the heads-up.
